Responsibilities and Conditions
General Conditions Of Booking:
Please read this information carefully. The payment of required deposit(s) or full payments for a reservation on any program in this brochure or flyer sent by Tye’s Top Tour & Travel, Inc. constitutes consent to all provisions of the terms and general information contained in this brochure or flyer. Tye’s Top Tour & Travel, Inc. acts in the capacity of an agent for airlines, cruise lines, hotels, and various other means of transportation and services. In the capacity of an agent, Tye’s Top Tour & Travel, Inc. cannot be held responsible if one of these suppliers become negligent or does not fulfill their contractual obligations, provided that due care was used in selecting these services. Tye’s Top Tour & Travel, Inc. is not responsible for acts of God, government shut downs, or acts of war.
Any person reserving any Tye's Top Tour & Travel, Inc. tour program accepts the condition that Tye's Top Tour & Travel, Inc. reserves the exclusive right to change or cancel tour itineraries, hotels, and other tour components whenever it is deemed necessary. If this occurs, every effort will be made to offer alternate dates or programs, or similar services.
Published times on our itineraries are as accurate as possible and subject to change due to traffic, weather, mechanical conditions and other conditions that prevent Tye's Top Tour & Travel, Inc. from operating under normal conditions. All rates published are per person as indicated. Most rates listed are based on double occupancy (unless otherwise specified). Reservations will be accepted subject to availability at the time of request and will be considered confirmed only upon receipt of deposit.
Every effort is made to handle passenger’s luggage as carefully as possible. However, Tye's Top Tour & Travel, Inc. cannot be responsible, assume liability, or accept claims for loss or damage to luggage due to breakage, theft, or fair wear-and-tear through hotel and group carrier handling. It is important for your own self interest and protection that you make certain you have adequate insurance to cover these eventualities. An insurance packet is enclosed with your tour documents.
In all matters relating to the making of arrangements for hotel and/or motel accommodations, sightseeing tours and service provided, entertainment, and transportation by air, rail, motorcoach, automobile, or ship, Tye's Top Tour & Travel, Inc. and its subsidiaries will act only in the capacity of an agent for the hotel/motels, airlines and other suppliers stated in the tour literature describing the services purchased. Because of its status as an agent, and because it maintains no control over the personnel, equipment or operations of these travel service suppliers, Tye's Top Tour & Travel, Inc. and its subsidiaries can assume no responsibility for and cannot be held liable for any personal injury, property damage, or other loss, accident or delay, inconvenience or irregularity which may be occasioned either by reason of 1) any wrongful, negligent, or unauthorized acts or omissions on the part of any suppliers, 2) any wrongful, negligent or unauthorized acts or omissions on the part of any employees of any of these suppliers, 3) any defect or failure of any vehicle, equipment, or instrument owned or otherwise used by any of these suppliers, or 4) any wrongful or negligent acts or omissions on the part of any other party not under the control, direct or otherwise, of Tye's Top Tour & Travel, Inc.
Security in public buildings
On your tour you may be entering into buildings that are protected by various levels of security. We suggest that any item that may be considered a weapon, be left on the coach or in your room. Your tour director will always assist you should you wish to mail an item home, but should an item be confiscated for any reason it is responsibility of the traveler to reclaim that item. Tours will not be delayed while a traveler tries to reclaim a confiscated item. Those of you that may carry pocket knifes or needles for any number of reasons must be aware that this items will make you a target for more stringent searches by authorized personnel.
Proof of Citizenship:
U.S. citizens traveling outside of the United States are required to carry documentation of U.S. Citizenship. Proof of citizenship will vary based on the travel destinations. The employees of Tye's Top Tour & Travel, Inc. will, to the best of their ability, advise you of the needed documentation. Non U.S. citizens will need to check with the appropriate consulates for entry requirements. Participants are responsible for obtaining proper travel documents. No refund will be made for failure to carry proper proof of citizenship, which leads to denied entry into or returning from a foreign country.
Cancellation within 60 days of tour departure will result in loss of deposit. Cancellation within 45 days of departure will result in a 25% penalty. Cancellation within 30 days of departure will result in a 50% penalty. Cancellation within 14 days of departure will result in 75% penalty. Cancellation within seven days of departure will result in no refund. In addition, airline tickets, event tickets, or theater tickets are non refundable once purchased. There will be no penalty with the exception of air, if the seat can be resold.
Airlines: Many airlines are in the process of merging and creating alliances, resulting in schedule changes and code share flights. As the airlines consolidate and eliminate non-profitable routes we often find the non-stop flights are going away. The airlines are also adding fees from everything from checking baggage; carry on luggage, weight restrictions, food, a pillow and any thing else they can think of. Tye’s top Tour & travel will do all we can to inform you of these fees and schedule changes but it is the individuals responsibility to verify flight times 24 hours in advance of travel. The airlines have no obligation to inform you of new fees or schedule changes but often try to notify as a courtesy. If you fail to check into an international flight 2 hours prior to departure the airlines reserve the right to deny you boarding. If you do not check in a minimum of 1 hour prior to your domestic flight the airlines can deny you boarding. You will also be denied boarding if you do not have a government issued id. Homeland security requires the collection of birth dates and sex of all travelers flying on any commercial aircraft in the US. Tye’s Top Tour & Travel acts only as an agent and can not be held responsible if you fail to reconfirm flights or the airlines charge you additional fees.
Cruise Cancellations: All cruise lines begin cancellation penalties for any cancellations made with in 75 days prior to sailing. 75 – 60 days prior to sailing the standard penalties are 25% 59 days to 45 days prior to sailing50%, 44 days to 30 Days prior to sailing 75%, within 30 days loss of all deposits and no refunds. Cruise lines expect to be paid in full before the penalty phase begins. All though each cruise line has its own policies this is the general rule of thumb.
A deposit of $250 will be required for all cruises less then seven nights in length and $400 for cruises greater then seven nights in length. A deposit of $100 per person will be required to reserve an air seat or rail seat. If a cruise involves air, the combined deposit will be $350. Tours oversees to Europe and Asia will require a total deposit of $450 per person. Motorcoach tours will require full payment for one day tours upon reservations, a deposit of $50 per person on tours 7 days or less, and a deposit of $100 on tours 7 days or longer. All theater or sports tickets will require payment for the cost of ticket at time of deposit. Some cruise lines will offer promotional fares that will require lower deposits.
Casino Bonus Package:
All casino bonus packages are bonuses and may be withdrawn or changed by the casino without notice.
All tour documents will be mailed approximately 21 days prior to tour departure, provided that full payment has been received. If the full payment the has not been received, the client will be responsible for any express shipping charges.
Disabled travelers requiring special attention or special treatment on any tour must be noted at the time of the reservation. Any person who is unable to travel independently or who needs any type of assistance must be accompanied by a companion who is able to provide the required assistance. At time of booking you must inform Tye’s Tour & Travel of any medical condition we need to be aware of including food allergies.
Cancellation insurance, additional medical insurance, and baggage insurance is available on all tours through Berkley Insurance. Cancellation insurance is highly recommended for those that have pre-existing medical conditions. Insurance must be taken at time of deposit and may be subject to additional insurance premiums. If group insurance is requested it must be added at the time of booking.
Assignment of rights:
We agree to assign the rights to all Government Service Tax to Tye’s Top Tour & Travel and are aware that we may not claim a rebate, for goods and services purchased as part of a tour. We have been advised that the rebate has been deducted as part of the tour. Should any government or court require the names and addresses of tour participants, we consent to providing these name and addresses. (I)We acknowledge that should names be required they may not be used for any other purpose then to satisfy a court request. We agree should a 100% satisfaction guarantee program need to be invoked we assign all rights of group and individuals to Tye’s Top Tour & Travel and will allow the tour company to negotiate a settlement on behalf of tour participants.
Payment for all one day tours is due upon reservations. The amount of deposit will be defined on the letter of agreement page. Final payment for all multi-day tours and cruises is due 60 days in advance. If bookings are made within 60 days of departure, full payment is due on reservation. Bookings made within 14 days of departure may be assessed a $25 late booking fee. Final payment for all group departures must be received in house 30 days prior to departure. No partial payments will be allowed on credit cards. On all Holiday Tours final payment is due 75 days in advance. On all packages final payment is due 75 days in advance. Although we will attempt to send reminder notices, it is the customer’s responsibility to know when final payments are due.
From time to time the airlines and motorcoach companies may impose fuel surcharges. Theses charges will be passed directly to consumers and will be payable prior to departure. Fuel sur charges are calculated for motor coach tours by using the price of $3.60 for diesel fuel. Any increase or decrease of twenty cents will result in a one dollar per passenger per day increase or decrease in price.
Taxes & Fees
Cruise lines, Airlines, State Governments, and the Federal Government may impose additional taxes. These additional taxes are the responsibility of the consumer. Tye’s Top Tour & Travel, Inc. may be required to collect these taxes in advance of departure to avoid congestion at point of departure, or these additional taxes may be collected at the airport.
Refunds for Cancellation
Tye’s Top Tour & Travel will be as flexible as possible concerning refunds and cancellations, however there is a cost involved in all cancellations and we urge you to protect yourself with travel insurance. An administrative fee will be charged of $25 for all non-medical related cancellations.
Threat of a gun or weapon
Verbally Abussive Patrons
Cruise credits: the cruise line as a marketing aid offer promotional credit referred to as amenity credits, which may be, withdrawn or distributed in any manor the cruise line deems appropriate.
Cruise parties: For many years cruise lines offered complimentary parties for groups, Each cruise line now determines what the minimum number of passengers is for a party. Some cruise lines have set minimums as high as 35 to receive a complimentary cocktail party. Should you wish to purchase a party this can always be arranged.
Special requests on Cruise ships: Should you require a special group function on board a cruise ship, there is often a set up and break down charge for the space required. These fees are often waived based on the size of the group and the services requested.
ADA compliance: Tye’s Top Tour & Travel is in full compliance with all ADA requirements. If you let us know at the time of booking that you will require a handicapped accessible room, or a room equipped for the hearing impaired we will do all that is possible to make these accommodations available to you. If you advise us that you need a coach with a lift we will find you a coach provided you advise us with enough notice to locate a coach. Coaches with wheel chair lifts have limited availability and must be requested as soon as a passenger needing this service makes a reservation. All passengers unless confined to a wheel chair, must be able to enter and exit the coach without assistance from the tour director or driver.
Tye’s Top Tour & Travel is a registered corporation in the state of New Hampshire. Any legal action taken against the corporation must be filed in a New Hampshire Court of Law.
